Home Showing Authorization

  

This Home Showing Authorization (“HS Agreement”) is made by and between _{{BUYER}}_(“Buyer”) as person(s) or entity interested in potentially purchasing real property known as _{{LOCATION}}__ (“Property”)  and _{{BROKER}}_, acting by-and-through its licensed real estate agent, _{{AGENT_NAME}}_ (together as "Broker").


1. Purpose of Agreement.

A. The purpose of this Agreement is to confirm Broker’s limited role in providing only the following services: (i) consult with Buyer regarding Buyer’s preferences and questions about specific properties; and (ii) assist Buyer in locating and touring properties. These activities collectively constitute the "Home Showing Services.”

B. In connection with providing the Home Showing Services, Broker shall comply with all non-waivable duties required under applicable state law for real estate brokers working with consumers in a non-agency capacity.

C. Buyer and Broker acknowledge and confirm they are not entering into an actual agency relationship under this HS Agreement and Buyer is not, therefore, Broker’s client.


2. Buyer's Acknowledgement (No Existing Broker Relationship Covering the Location). 

Buyer represents that Buyer has not signed an exclusive buyer brokerage agreement, with any other broker and/or agent, for the Location referenced herein.


3. Nature of Agreement/Duration. 

Buyer and Broker enter into this HS Agreement because Buyer has requested to tour the Property (as identified in the first paragraph). Buyer is not obligated to utilize Broker’s services, including scheduling tours of other properties; however, Buyer is free to utilize Broker for other services of its own choosing, including tours of other properties. The terms and conditions of this HS Agreement shall apply between Broker and Buyer should Buyer request that Broker perform the duties referenced in Paragraph 1A regarding additional properties – i.e., this HS Agreement shall continue to apply if Buyer requests that Broker provide Home Showing Services to other properties.


4. No Buyer-Paid Fee for the Home Showing Services hereuder.

A. Buyer shall not owe or pay Broker any fee for the Home Showing Services (i.e. Broker is not charging Buyer a fee for the services rendered under this HS Agreement).

B. If Buyer requests that Broker provide services beyond the Home Showing Services, Buyer & Broker will enter into a separate agreement for such additional brokerage services. Buyer and Broker shall negotiate the fee and/or commission payable by Buyer for those services, with the agreed-upon fee/commission schedule to be documented in that (separate) written agreement.

C. Buyer is advised that Broker may receive payment from Essential Real Estate, LLC, d/b/a HomeTraq, a licensed real estate broker (“HomeTraq”), pursuant to a separate agreement between Broker and HomeTraq for performing the Home Showing Services; and, further, if HomeTraq is determined under relevant state law to be the procuring cause of a real estate transaction that culminates in a final closing handled by Broker, HomeTraq could be entitled to receive a certain percentage of the commissions and/or fees earned by Broker under any agreement between Broker and Buyer. Any commissions and/or fees earned by HomeTraq will be drawn from the Broker’s commissions and/or fees and not as an additional charge to Buyer.


5. Equal Opportunity. 

Properties shall be shown and be made available to Buyer without regard to race, color, religion, sex (including sexual orientation and gender identity), disability, familial status, national origin, and as may be required by other local, state or federal anti-discrimination laws or regulations.
